CONSTITUTION
OF THE COLLEGE
STUDENT’S
UNION :

ARTICLE
– 1
Name :The
name of the Union shall be, “ The
Capital Law College, Bhubaneswar,
Student’s Union and it shall hereinafter
be referred to as “ the Union” |

ARTICLE – 2
Working Year :
The working year of
the Union shall be the academic year.
ARTICLE – 3
Membership of the
Union :
Every student of the
Capital Law College, Bhubaneswar shall be a member
of the Union and can contest in the election to the
Union unless otherwise disqualified.
A student guilty of
moral turpitude or convicted on a criminal charge by
a Court or whose result is with held by the
University for malpractice or adopting proxy in an
examination stands disqualified for the purpose of
this Article.
ARTICLE – 4
Functions of Union :
The Union shall remain
as the sole tribune of the opinion of the Capital
Law College, Bhubaneswar. The Union shall have the
following functions :-
a)To organize
discussions on the legal, general cultural academic,
national and international problems.
b)To organize debates
and study circles ;
c)To solicit eminent
persons to address the Union in consultation with
the Principal;
d)To organize annual
day, exhibition or other show and to encourage
students to take part in cultural activities ;
e)To develop
fellow-feeling and active social life among students
by organizing picnics, excursions, study tours and
by providing other activities for social
intercourse.
f)To encourage
students in taking their legitimate part in creative
activities and cultural life of the nation ;
g)To encourage the
students to render their social services such as :
1)To open and
encourage night school,
2)To open centers for
adult education,
3)To organize relief
squads and ambulance work,
4)To work for removal
of untouchability, caste distinction, illiteracy,
corruption and other social evils,
5)To help the poor and
meritorious students of the Law College and,
6)To organize legal
aid camps.
ARTICLE – 5
Right of the members
of the teaching staff to
participate in the
Union meetings
All meetings of the
Union shall be open to the members of the teaching
staff, who if they so desire may take part in the
proceedings of the meeting but shall have no right
of voting.
ARTICLE – 6
Officer Bearers :
The following shall be
the Office Bearers of the Union :
1)The President
2)The Vice-President
3)The Secretary
4)The Assistant
Secretary
ARTICLE – 7
Union Executive Body :
There shall be an
Executive Body of the Union consisting of the
following members ;
1)President
2)Vice –President
3)Secretary
4)Assistant Secretary
5)Class
Representatives
ARTICLE – 8
The Adviser :
a)The Principal shall,
soon after election to the Union, nominate a member
of the teaching staff to be Adviser of the Union.
b)The Adviser shall be
present at the ordinary meetings of the Union and
shall assist in proper conduct of the meetings. The
President may also refer to the Adviser any Article
of this constitution for interpretation and the
decision of the Adviser on all such matters shall be
final.
c)The Adviser may
preside over a meeting whenever he will be requested
to do so by the President.
ARTICLE – 9
The President :
There shall be a
President for the Union. Any member of the Union is
eligible to stand for the Presidentship of the
Union. The President shall preside over all ordinary
meetings of the Union at which he is present. He
shall be responsible for maintaining order in all
meetings.
The President’s ruling
on interpretation of the provision of the
constitution shall be final except in cases where
the President has referred a matter to the Adviser.
In shall such cases of reference the Adviser’s
opinion shall be final and binding.
ARTICLE – 10
The Vice-President :
There
shall be a Vice-President for the Union. He shall be
elected from among the students. In the absence of
the President, the Vice-President shall assume all
his rights and discharge all his duties. In case of
the office of the President falling vacant due to
death resignation. Discontinuance or expulision from
the College, the Vice-President shall act as the
President, till the expirty of the academic
session.
ARTICLE – 11
The Secretary :
a)There shall be a
Secretary for the Union, who shall be elected from
among the members of the Union.
b)The Secretary shall
have the following duties :
1)To arrange all
meetings, whether annual, ordinary or
extra-ordinary.
2)To arrange debates,
discussions etc. and to do all other things declared
to be the functions of the Union in Article-4.
3)To maintain Accounts
of the Union.
ARTICLE – 12
The Assistant
Secretary :
a)The Assistants
Secretary shall assist the Secretary in the
discharge of his duties and shall perform the
function of the Secretary during his temporary
absence.
b)The Assistant
Secretary shall act as the Secretary of the Union
till the expiry of the academic session in case of
death, resignation, discontinuance or expulsion of
the Secretary before the expire of his team.
ARTICLE – 13
Class Representative :
Students of each class
shall elect one Representative who shall represent
them in the Executive Body of the Union.
ARTICLE – 14
Method of Election :
a)The election to the
Executive Body of the Union shall be ordinarily held
after the completion of all admission to all the
classes.
( Admission shall be
presumed to have been completed for Inter Law and
Final Law classes within such number of days as
prescribed by the University statutes after the
re-opening of the College after summer vacation and
for Pre-Law class after the first spell of admission
fixed, as per statutes of the University, is over ).
b)At least ten days
clear notice must be given by the Principal for
holding of elections.
c)Every member of the
Union has the right to vote in the election to the
Executive Body.
d)Election shall be
conducted by secret ballot.
e)Candidate getting
the largest number of votes shall be declared
elected. In case two or more candidate secure equal
number of votes the winning candidate will be
declared by drawing of lots.
f)Nomination by the
candidates for all the posts must reach the
principal at least ninety six hours before the time
fixed for the elections.
g)List of valid
nominations shall be placed in the notice board at
least seventy two hours before the commencement of
the elections.
h)Withdrawal of
nominations shall be allowed forty eight hours
before the time fixed for the elections.
i)The principal may
frame rules for the following :
1.Filling of
nomination by the candidates.
2.Scrutiny of such
nomination papers.
3.Declaration of valid
and invalid nomination papers.
4.Manner of casting of
votes by the students.
5.Manner of counting
of votes and declaration of results.
6.Drawing of lots in
case of equality of votes.
7.Other rules for
proper conduct of the elections.
8.Principal’s decision
in all matters with respect to the election shall be
final.
ARTICLE – 15
Vacancy of Office :
An office of the Union
mentioned in Article – 7 shall be deemed to be
vacant in case the office bearer :
1.Voluntarily resigns
in writing addressed to the Principal.
2.Is expelled from the
College or ceases to be a student for any reason.
3.Dies during his term
of office and
4.Is ousted from
office by a vote of no confidence brought and passed
against him according procedure prescribed.
ARTICLE – 16
Filling up of the
vacant office :
An office falling
vacant other than that of President and Secretary
shall be filled up by nomination of the Principal
from among the other students of the College,
Principal’s decision, in the matter of filling up
vacant offices shall be final.
ARTICLE – 17
Annual Meeting :
Soon after
the formation of the College Union Executive Body in
each academic session an annual meeting will be held
to welcome the new members of the Executive Body.
The Principal shall fix a date ordinarily not latter
than one week after the elections for holding the
meeting. In this meeting the Annual Report of the
Union for the previous year shall be presented by
the out-going Secretary. In case he has ceased to be
a student, such report shall, with the permission of
the Principal be presented and read out by the new
Secretary. The Principal or his nominee from among
the staff shall preside in the meeting.
ARTICLE – 18
Ordinary Meetings :
1.Ordinary meeting
shall be arranged by the Secretary in consultation
with the President.
2.Seven days clear
notice must be given to the Principal by the
Secretary for holding of an ordinary meeting so that
the Principal may circulate the date, time, subject
and the first four speakers of the meeting in the
General classes.
ARTICLE – 19
Extraordinary Meetings
:
1.An extraordinary
meetings of the Union may be convened,
a)by the Principal at
his discretion,
b)by not less than
fifty members of the Union on written requisition
addressed to the Principal and
c)by the President.
2.The Principal or his
nominee shall preside in such meeting.
3.Three clear days
notice must be given by the Principal for holding
such meeting.
ARTICLE – 20
Meetings the Executive
Body :
The meeting of the
Executive Body shall be held as often as the
President desires or on a written requisition by not
less than four members of the Executive Body
addressed to the Principal.
ARTICLE – 21
Quorum :
1.The Quorum for the
meeting of the Union shall be 1/5 th of the total
membership or 100 whichever is less.
2.The quorum for all
Executive Body meetings shall be five.
ARTICLE – 22
Invitation to
Non-members for Debate and Address :
The Secretary may
request the Principal to invite such persons who are
not members of the College to take part in the
debate or address the Union. In case of debates such
persons will speak after the motion has been duly
proposed by members of the Union.
ARTICLE – 23
Amendments of motion :
a )Notice of amendment
must be put into the box reserved for that purpose
in College Office at least one clear day preceding
the date of the meeting.
b )No amendment shall
be allowed which in effect directly is opposed to
the original motion of debate or is inconsistent
with the motion.
ARTICLE – 24
Procedure in the
meetings :
a)In the absence of
both President and Vice-President in an ordinary
meeting, the members present shall elect a Chairman
from among themselves, the Adviser or his deputy
taking the chair until the election is over.
The Chairman shall
assume all the rights and discharge all the duties
of the President during the meeting.
b)At the commencement
of each ordinary meeting the Secretary shall read
the minutes of the last ordinary meeting. The
minutes on being approved by the members present
shall be signed by the President.
c)Every speech shall
be relevant to the subject of debate or the
amendment proposed, No personal reflection shall be
made in course of a meeting.
d)No member other that
the mover of the motion shall speak more than once
in course of the debate. At the conclusion of the
debate the mover may at his option reply to the
debate.
e)The President may,
if he so desires, take part in the debate. The
Vice-President’s or in his absence some one else at
the President’s request shall then be taking the
Chair.
ARTICLE – 25
Discussion of
Amendment :
a)Not more than one
amendment to the discussion may be brought for ward
in the course of an ordinary meeting.
b)The President of the
ordinary meeting shall decide at the meeting which
one of the amendments received in accordance with
Article 27(a) shall form the subject matter of the
debate.
c)An amendment to a
motion shall be discussed only after the first four
speakers on the motion have spoken.
d)No amendment shall
be valid which is not duly recorded in the meetings.
e)When an amendment is
proposed and seconded, members may, at their option,
speak either on the amendment or on the original
motion.
ARTICLE – 26
Vote on debate :
a)At the conclusion of
the debate, as soon as the mover of the original
motion has exercised or formally surrendered his
right of reply, the amendment if any shall first be
put to vote. If the amendment is lost, the original
motion shall then be put the vote, if the amendment
is carried the motion as amended shall be put to
vote.
b)If the votes are
equally divided the President shall decide the issue
by lot.
ARTICLE – 27
Points of order :
The Adviser, his
deputy or any member may draw the attention of the
President to a point of order even while a member is
speaking but no speech shall be made on such point
or order.
ARTICLE – 28
Point of Information :
The Adviser, his
deputy or any member may draw the President’s
attention to a point of information even while a
member is speaking.
ARTICLE – 29
Discipline :
a)The President may
call any member to order. If a member disobeys or
disregards any order or ruling of the President or
the Adviser or of his deputy, the President may
forthwith ask the member to withdraw from the
meeting or may report his name to the Principal. If
necessary the President may dissolve the meeting.
b)In matters, not
provided for by these rules, the Adviser or his
deputy shall give a ruling regarding the procedures
or the principles already laid down and his ruling
shall be final.
ARTICLE – 30
Disqualifications :
No person shall be
eligible to contest in any election of the College
Union if either he has not paid the up-to-date
College fees or if any disciplinary action has been
taken by the Principal for his Mis-conduct or if his
result is withheld for examination malpractice by
the University.
ARTICLE – 31
Vote of No-confidence
:
1.A vote of
no-confidence against any office bearer of the Union
can be brought by giving to the Principal a notice
signed by not less than one fourth number of members
of the Union.
2.The Principal, on
receipt of the notice, shall cause it to be widely
widely circulated among the students and also put it
up on the notice board.
3.The Principal shall
call an extra-ordinary meeting of the College Union
after the expiry of fifteen days from the date of
receiving the notice in which the motion shall be
discussed and voted upon.
4.The motion shall be
deemed to have been passed if two third of the
members present in the meeting vote in favour of it.
5.Upon the passing of
the motion the office bearer against whom the vote
of no-confidence has been drought shall be deemed to
have vacated his office.
ARTICLE – 32
All amendment to the
constitution of the College Union may be made by the
Executive Body passed by not less than 2/3rds of the
total membership provided that no such amendment
will be valid, unless it has been introduced and
passed in a specially convened meeting with prior
approval of the Principal.
